Introduction

FlexiPark.io (FlexiPark) is an online platform and mobile application that allows you to digitally access parking.

This agreement is between FlexiPark (“we”) as web site operators & owners and (“You”), the users of FlexiPark.

The definition of a (“User”) would be somebody that is using, has used or has viewed the web site (“FlexiPark”) or the FlexiPark mobile application available on both IOS and from the Android Play Store.

Please read these Terms carefully before you start to use the website or mobile application. By accessing the FlexiPark mobile app or website and using the platform (FlexiPark) you are entering into this agreement & you are confirming that you have read and fully agree to these Terms and Conditions. If you do not agree with these Terms, do not use the FlexiPark mobile app, website or its associated service.

Any changes will be posted here, and will apply from the time of posting. We reserve the right to amend these Terms and Conditions from time to time without providing any forewarning. However, should there be any significant changes in regards to your data or the way it is used, we will of course notify you by forewarning.

General Terms and Conditions

Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE.

United Arab of Emirates is our country of domicile.

Minors under the age of 18 shall are prohibited to register as a User of this website and are not allowed to transact or use the website.

If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection.

The cardholder must retain a copy of transaction records and Merchant policies and rules. FlexiPark will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE. We accept payments online using Visa and MasterCard credit/debit card in AED.

FlexiPark reserve the right to terminate any subscription prematurely or end a renewal for any reason. For security reasons we may be unable to disclose the basis of our decision.

All payments made to flexipark are non-refundable.

Payments can be made for flexipark subscriptions either monthly or yearly. Flexipark only accepts credit/debit card payments for monthly subscriptions and may accept bank transfer/cheque payments for yearly subscriptions.

Privacy Policy

All credit/debit cards details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties.

We take privacy seriously and as such will not sell, share, rent or lease your private data to any third party providers outside of the necessary stakeholders required to provide the service.

Any geolocated data will only be used for the purpose of providing the service and we will only ask for permission to access the data whilst you are using the FlexiPark app.

For some phone users when using FlexiPark, specifically Android users, we may ask for you to have your Bluetooth turned on only whilst using the app. The is so we can provide you with a smooth service of barrier opening.

Your Responsibilities as a User

You agree that FlexiPark is a service to access parking locations.

You agree you are using the parking facility at your own risk & indemnify the parking space owners, their staff, FlexiPark & its staff for any loss or damage to vehicles and their contents left within the parking facility.

We offer no guarantee as to the condition of the parking spaces. The owner of the space is responsible for ensuring the parking space is fit for purpose, we offer no guarantee of this.

You agree that whilst using FlexiPark to open a barrier your vehicle is stationary in front of the barrier with your foot brake on.

You agree not to obstruct other parking spaces or property when parking.

All persons entering the car park & utilising FlexiPark do so at their own risk and neither the Owners, FlexiPark nor any person acting on its behalf is in any way responsible for any loss, injury or damage sustained by them or for loss or damage to vehicles and their contents left within the car park.

Our Promise

We reserve the right to suspend or restrict access to the site for the allowance of repairs, maintenance or the implementation of new features or services. In this event, we will make every effort to restore access to the site as quickly as reasonably possible.

Your information will never be sold or rented to third parties for any purpose.

Limitation of Liability

In no event of circumstance shall FlexiPark be liable for any special, indirect or consequential damages, or any damages whatsoever resulting from loss of use, data or profits, arising from the use or in connection with the use or performance of the app or any information obtained from us.

In no event of circumstance shall FlexiPark be liable for any special, indirect or consequential damages, or any damages whatsoever resulting from accessing, exiting, using and or parking vehicles within the parking lot. You agree that you are parking your car at your own risk.

We will not be liable for any economic, business, or financial damage, nor for any indirect or consequential loss to you arising as a result of your use of the app.

We hold no responsibility for any computer virus transmitted through the site. It is your responsibility to make use of appropriate anti-virus software when using the site, and act with caution as with any other online transaction.

It is your responsibility to verify any information that you may obtain on FlexiPark with the relevant authorities before acting upon it.
